STEPHEN JONAH ADAH, JCA. (Delivering the Leading Judgment): This is an appeal filed by the appellant against the decision of the High Court of the Federal Capital Territory, Maitama, Abuja in Suit No: FCT/HC/CR/141/2006, delivered on the 27th day of November, 2014 (Coram: S.E. Aladetoyinbo, J.)

The Respondent on the 13th December, 2006 by An Amended Charge arraigned the appellant together with two others on a Seven Counts charge of Armed Robbery punishable under Section 1(2) of the Robbery and Firearms (Special Provisions) Act Cap 398, LFN, 1990.

The facts of this case are briefly in this wise. The appellant along with two other accused persons and three female companions on 23rd of March, 2006 were arrested and taken to Utako Police Station on their way back from a Night Club in Abuja. They were not able to provide their Driver’s licenses and particulars of their vehicle when it was requested from them by the security men.
