Judgement

ESSIEN J. (DELIVERING THE RULING): The defendants by a motion on dated 27th February, 2018 and filed on the 13th March, 2018 sought an order striking out or in the alternative dismissing this suit filed on the 30th September, 2014 for being statute barred. The ground of the objection as stated in the motion paper is that the suit ought to have been commenced within 3 months against the defendants who are statutory bodies in accordance with section 2(a) of the Public Officers Protection Act Cap. P.41 Laws of the Federation of Nigeria 2004.

In support of the motion on notice is a 6 paragraph affidavit deposed to by one Victor Ekeowa. Also in support of the preliminary object is the written address of the defendants counsel.
