MR. EKAKAMO JECOB ENI V. NIGERIA IMMIGRATION SERVICE AND 3 ORS

INTRODUCTION

This suit was commenced by way of Complaint on 11^th February 2014. This was accompanied with the Statement of Facts to which the 1^st-3^rd defendants filed a joint Statement of Defence on 12^th June 2014. Subsequently, the claimant filed an Amended Statement of Facts on 21^st April 2015. At paragraph 25 thereof, the claimant claimed the following reliefs:

(a) A declaration that the Defendants’ act of stopping the payment of the Claimant’s monthly salaries since February 2007 till date, even while posting the Claimant to duties and using his services, is ultra vires the Defendants, and so null and void.

(b) A declaration that the 1^st Defendant is owing the Claimant arrears of salary as follows, as at the date on which the purported Dismissal Letter was delivered to the Claimant:
