Judgement

ESSIEN J (DELIVERING THE RULING): The defendant/applicant by a motion on notice dated and filed on the 20th March, 2018 sought an order of this court striking out this suit for lack of jurisdiction.

The grounds upon which the application is brought are:

1) That the suit is not a trade dispute between employer and employee.

2) That the suit relates to right of position among members of Nigerian Union of Journalist Enugu State Council.

3) The issue in the suit is not also about employment matters, industrial relations, matters arising from workplace, industrial actions.

In support of the application is a 5 paragraph affidavit deposed to by the 2nd defendant/applicant. Also in support of the application is the written address of the applicant counsel.

In response to the applicant’s process, the claimant/respondent filed a counter affidavit of 7 paragraphs on the 29th March, 2018 and a written address in support of the counter affidavit.
