JUDGMENT
 ASUMAN-ADU, J.
The plaintiff issued out writ of summons against the defendant on 15th July, 2004 for the following reliefs:
1. A declaration that the so-called customary marriage purportedly entered into in 1983 by the defendant and the late Emmanuel Kwame Dugbley is a nullity in Law, since at the time it was alleged to have been done, there was in existence the marriage with the plaintiff
2. A further declaration that the plaintiff herein is the only lawful widow at law of the late Emmanuel Kwame Dugbley (deceased)
3. An order that the plaintiff, the only surviving widow, she and children be granted their share of the Estates of the late Emmanuel Kwame Dugbley under PNDC Law 111 of 1985.
In an attached Statement of Claim, the plaintiff avers that on the 10th day of July, 1969 she got married under the Ordinance to the late Emmanuel Kwame Dugbley at the St. Peter’s Catholic Church, Osu, Accra. The said marriage was blessed with five children and that she knew the defendant as a pa…
