ESSIEN J (DELEIVERING THE RULING): The Defendant/Applicant by a Notice of Preliminary Objection dated the 13^th February, 2017 and filed on the 17^th February, 2017 sought an order of this court dismissing/striking out this suit on the grounds of incompetence and lack of jurisdiction.

In support of the application is a 16-paragraph affidavit deposed to by the 1^st defendant, Idika Kalu. Also in support of the Notice of Preliminary Objection is a written address of the applicant’s counsel. Attached to the affidavit in support are Exhibit A and Exhibit B.
