JUDGMENT
On 2nd February, 2012, the Plaintiff herein, M/S Akoko Goldfields Ltd. commenced the current action against the Defendant for the following reliefs:
(i) An order directed at the Defendant Company to specifically perform the Terms and Conditions of the Agreement signed between the Plaintiff Company and the Defendant Company on the 4th May 2010.
(ii) Exemplary general damages for intentionally and maliciously dragging the good name of the Plaintiff in mining circles into disrepute by falsely accusing before the Police its Chief Executive through reports to International Economic Fraud Squad on malicious and false charges of the Plaintiff having defrauded the Defendant by false pretences that it has a good concession.
(iii) Compensatory general damages for breach of contract.
(iv) Punitive solicitor’s costs
The Plaintiff attempted to serve the Defendant with the writ together with a statement of claim but it could not locate the Defendant to serve so it applied for substituted service…
