BABA ALKALI BA'ABA, JCA (Delivering the Leading Judgment): This is an appeal against the judgment of the Kaduna State High Court, Kaduna State Judicial Division presided over by Hon. Justice Munir Ladan of the Kaduna State High Court, delivered on 1st day of April, 2008.
Being dissatisfied with the judgment of the trial court, the appellant who was the defendant has now appealed against the said judgment to this Court by filing a notice of appeal containing three grounds of appeal to be found at pages 85-87 of the printed record.
The respondent's claim against the appellant at the trial court on the endorsed writ dated the 22nd day of October, 2007 reads as follows:
