OLABODE ABIMBOLA ADEGBEHINGBE, J.C.A. (Delivering the Lead Judgment): This is an appeal against the judgment of the Customary Court of Appeal, Yola, which was delivered on 13/10/2020. 

The Customary Court of Appeal sat in its appellate capacity over the decision of the trial Upper Area Court (sitting in Guyuk), dated 28/03/2018, in Suit No. GUY/UAC/CV/F1/15/2017. 

The Customary Court of Appeal decided that the suit, which was on appeal before it, should be remitted back for retrial by the trial Upper Area Court. 

The Appellant was unhappy with the judgment of the lower Court. He, therefore, filed a notice of appeal against that judgment, on 11/06/2024, which contained fifteen (15) grounds of appeal.
