Judgement

ADAH, J.C.A. (Delivering the Leading Judgment): At the Rivers State High Court Isiokpo Judicial Division the respondents as plaintiffs took out a writ of summons claiming against the appellants as defendants the following reliefs:

The sum of N5,000,000.00 (Five Million Naira only) as damages occasioned by defendants’ trespass to the subject farmland and malicious removal of the “OKPO” boundary demarcation and destruction of the plaintiffs’ economic trees, namely Otoru, Oil bean, i. Ogbakiri and Owiriwa trees.

ii. The sum of N1,050,000.00 (One Million and Fifty Thousand Naira only) as compensation for loss of contemplated remunerations for 10 family members at N35,000.00 per month for negotiated minimum period of three months.

iii. The sum of N500,000.00 (Five Hundred Thousand Naira only) as exemplary damages for the brutal harassment of plaintiffs family and psychological torture caused on plaintiffs by the defendants.
