BIOBELE ABRAHAM GEORGEWILL, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the Federal High Court Lagos Division Coram: A. M. Liman J., in suit No. FHC/L/CS/1131/2003: Prudential Union Assurance Plc. V. National Insurance Commission delivered on 29/l/2009, in which the reliefs numbers 1,2, and 4 were granted in connection with the earlier judgment delivered on 15/6/2006 in the same suit by the same Court, Coram: A. O. Ogie J (as she then was, now JCA).

The Appellant, which did not appeal against the earlier judgment of the Court below delivered on 15/6/2006, was however peeved with the judgment of the Court below delivered on 29/1/2009 and had promptly appealed against the said judgment vide a Notice of Appeal on six grounds filed on 25/2/2009 @ pages 144 - 148 of the Record of Appeal.
