Judgement

JUDGMENT

The plaintiff was a customer of 1st defendant company operating a telephone network called as Areeba but now known and called M. T. N.

The 1st defendant is a company registered under the laws of Ghana and engaged in the provision of Mobile Telecommunication and other related services.

Accordinging to plaintiff she sent her nokia phone to defendant on 26th October 2006 to have her multimedia messaging system (MMS) configurated.

Upon completion of the work she noticed that much of her credit had been used by 2nd defendant who was then an employee of the 1st defendant company.  She also noticed that pictures which she described as nude, private and confidential were sent to the phone of 2nd defendant. In the process, 2nd defendant fell on a friend and pleaded with her not to report his conduct to his employer because his conduct was unprofessional. The 2nd defendant also made several calls and sent text messages all pleading for forgiveness.
