Judgement

STEPHEN JONAH ADAH, JCA (Delivering the Leading Judgment): This appeal is against the decision of the High Court of Niger State, Lapai, in Suit No NSHC/LP/64/2012 delivered on 22nd day of January 2014 by I.M.J. Evuli, J.

The Respondent was the Plaintiff at the lower court while the Appellants were the Defendants.

The matter was originated through a writ of summons wherein the Respondent claimed five reliefs. These reliefs are as follows:-

(a) A DECLARATION that all land situate at and called Gbawugi land is being administered by the Village Head of Wanigi Village.

(b) A DECLARATION that all land purportedly sold or administered by the Defendants jointly and or severally is illegal, null and void.

(c) AN ORDER that the Defendants jointly and or severally are not entitled to receive any tribute over the land, subject matter of this suit.
