ADAMU JCA (Delivering the Lead Judgment): This appeal is against the ruling of the Federal High Court, Calabar, dated 6/10/98 in suit No. FHC/CA/M9/97 by Hon. Justice C. C. Nwaogwugwu. In the suit leading to the said ruling, the respondent (as an applicant) in a motion ex-parte sought for leave to apply for an order of certiorari to bring up and quash the proceedings and findings of an ad hoc disciplinary committee set up by the respondent/appellant which led to the termination of the appointment of the applicant/respondent (hereinafter called “the respondent”) and to declare the proceedings and recommendations of the ad hoc committee, as well as the decision taken on them by the respondent/appellant (hereinafter called “the appellant”) null and void as they were in excess of the powers of the committee and were a violation of the respondent’s right to fair hearing.
