Judgement

MANGAJI, JCA (Delivering the Lead Judgment): This is an appeal from the judgment of Oyetunde, J., of the High Court of Justice, Plateau State sitting in the Jos Judicial Division in suit No. PLD/J838/95 dated 27/4/98, wherein the termination of the appointment of the respondent by the appellant was declared to be “in breach of the contract of service existing between them.” Accordingly, the learned trial Judge awarded to the respondent, as plaintiff, “the sum of N350,000.00 as damages against the defendant.” The appellant, who was the defendant at the court below, felt aggrieved by the decision and accordingly appealed to this court. The notice and ground of appeal dated 30/9/99 contained five grounds of appeal.
