Judgement

HELEN MORONKEJI OGUNWUMIJU, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the Customary Court of Appeal Anambra State holden at Awka delivered on 20/12/2011 whereby the said appellate Court allowed the appeal of the Respondents herein and set aside the judgment of the Customary Court Mbanano, holden at Umuoji and granted the Respondents all the reliefs they sought for in their claim at the Customary Court, Mbanano.

It was against the judgment of the Customary Court of Appeal of Anambra State that the Appellants who were the Respondents in the Court below, have appealed to this Court.

The Respondents as Plaintiffs took out an action against the Appellants at the Customary Court of Anambra State holden at Mbanano claiming the following reliefs:

a) Declaration that the Plaintiffs are entitled to a Customary right of occupancy over a piece and parcel of land called Owelle-Ata situate at Dimboko village, Umuoji within the territorial limit of the Court
