ALAGOA JCA (Delivering the Lead Judgment): This is an appeal against the rulingof Liman J. of the Federal High Court Kaduna in suit No. FHC/KD/CS/27/2003 delivered on the 26th March 2004. The facts of this case as can be gleaned from the printed record and the respective briefs of the parties are that by an originating summons dated the 9th July, 2003 and filed same day, the respondent asplaintiff formulated the followingquestions for the determination of that court:- “Whether the plaintiff who has served the defendant on a permanent and pensionable employment for nineteen years can be deprived of his pension where his employment was not terminated for any wrong doing. Whether there is anything in the contract of employment between the parties to justify the defendant to deprive the plaintiff of his pension having qualified for same.

Whether havingregard to section 173 of the 1999 Constitution and Articles 2.3.1, 15.1.1, 15 (2)( c), 15.3, 15.4 and 15.4.3 ofthe defendant’s conditions …
