OANDO PLC V. TAOFIK MOHAMMED NOFIU & ANOR

MODUPE FASANMI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the decision of the Federal High Court, Abeokuta, Ogun State in Suit No. FHC/AB/CS/22/2005 delivered on the 14th of April 2008.

The claim of the Respondents who were Plaintiffs at the trial Court is set out in the Amended Statement of claim dated 12th of December 2006 but filed on the 14th of Dec. 2006 at pages 274-275 of the record as follows:

1. A Declaration that the 1st Plaintiff is entitled to resign his dealership with the 1st Defendant in respect of the Oando Plc. Service Station at Old Ondo/Benin Road, Imepe, Ijebu Ode, Ogun State.

2. A Declaration that the 1st Plaintiffs resignation of his dealership with the 1st Defendant in respect of the Oando Plc. Service Station at Old Ondo/Benin Road, Imepe, Ijebu Ode, Ogun State by virtue of the Letter of Resignation dated 20th January 2005 is valid.
