JUDGMENT

INTRODUCTION:

This is an interlocutory appeal by the 2nd Defendant against the ruling of the High Court dated 11th March 2024 granting as prayed by the Plaintiff an order of interlocutory injunction restraining the Defendants, their servants, agents, assigns, privies, workmen and all persons claiming through them from entering, developing, disposing of, operating on, or in any way dealing with the disputed land until the final determination of the suit.

Suffice it to say that the nature of the order made by the trial court is itself an interlocutory order of injunction, and that same has not been appealed against by the 1st Defendant.

On 21st June 2023, the Plaintiff/Applicant/Respondent (hereinafter referred to as “the Plaintiff”) sued the 1st and 2nd Defendants/Respondent/Appellants (hereinafter referred to as “the Defendants”).
