Judgement

TUNDE OYEBANJI AWOTOYE, J.C.A.(Delivering the Leading Judgment): This is the judgment in respect of the appeal against the judgment of Imo State High Court delivered on 7/5/2014 against the defendant as per paragraph 54 of his Amended Statement of Claim as follows:

Wherefore the Claimant claims against the Defendant as follows:

(a) A declaration that the Claimant is entitled to all the lands of late Okonkwo Agwaraonye by virtue of the custom and traditional of Obibi Ochasi and entitled to the grant of Customary Right of Occupancy over all the lands of the Okonkwo Agwaraonye at Nwokeji, Ohulo Oroagwau, Ama-Ugbor, Ukwu Ube, Ala-Ezeduru and Oru Aguluonye, the dimensions, size and boundaries of which are known to the parties and not in dispute.

(b) An Order of perpetual injunction restraining the Defendant himself his privies and successors-in-title from selling and/or trespassing into the Claimants lands afore cited viz; Okpotokpo Okonkwo Okeohia, Ama-Okorie Omeja, Ohulo Nwokeji, Ohulo Okor…
