HARUNA SIMON TSAMMANI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the Ogun State High Court delivered on the 14th day of February, 2011 by Majekodunmi, J in Suit No. HCS/02/2007.
By a Writ of Summons and Statement of Claim dated and filed on the 5th day of January, 2007, the Respondents/Cross-Appellants who were the Plaintiffs sought the following reliefs:
(a) AN ORDER OF PERPETUAL INJUNCTION restraining and/or prohibiting each and both of the Defendants by themselves, their agents, servants and privies from further inter-meddling with and/or trespassing on the Plaintiffs properties, the subject of this suit, and from further having or keeping in their custody the title documents, the subject of this suit.
(b) AN ORDER OF MANDATORY INJUNCTION directing the 1st and 2nd Defendants to hand over or deliver up to the Plaintiffs the said title documents, the subject matter of this suit.
