ABBA BELLO MOHAMMED, J.C.A. (Delivering the Leading Judgment): Before the Ogun State High Court (hereinafter referred to as “the trial Court”), the Appellant, as Claimant, instituted Suit No. AB/03/2018 via Writ of Summons, wherein he claimed the following reliefs against the Defendant who is the Respondent herein:

1. A DECLARATION that the Claimant is the person entitled to the statutory right of occupancy in respect of the Oduntan family landed property lying situate and being along Ibadan-Lagos Expressway, Ibafo, Obafemi/Owode Local Government Ogun State, in an area measuring approximately 18060.000 square meters (4.484 Acres) of land, covered by Survey Plan No. OOJ/512/069/1990 dated 18th April, 1990, signed by O. J. Ogundiran, Registered Surveyor, which belongs to him by inheritance.
