HARUNA SIMON TSAMMANI, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the Ogun State High Court, Sagamu Judicial Division, delivered on the 13th day of June, 2013 in Suit No. HCS/1C/2010.

The Appellant herein was charged, tried and convicted with two others for having committed the offences of conspiracy to commit armed robbery and two counts of armed robbery, which offences are punishable under Sections 6(b) and 1(2)(a) of the Robbery and Firearms (Special Provisions) Act, Cap.R.11, Laws of the Federation of Nigeria, 2004. The Appellant who was the first accused person at the trial, was said to have conspired with two other persons, i.e, Oladipupo Ojubajo and Oluwaseyi Adebayo, on the 30th day of December, 2007 to rob one Florence Adenugba of the sum of five hundred thousand naira (₦500,000.00 only).
