OBANDE FESTUS OGBUINYA, J.S.C. (Delivering the Lead Judgment): This appeal probes into the rightness of the decision of the Court of Appeal, Lagos Division (hereunder addressed as "the lower Court"), coram judice: A. A. Augje, Y.S Nimpar and J. Y. Tukur, JJCA, in Appeal No. CA/L/444/2014, delivered on the 22nd April, 2016. In its judgment, the lower Court set aside the decision of the High Court of Lagos State (the trial Court), in Suit No. LD/1279/2007, delivered on the 24th December, 2013, wherein Oluyinka Gbaja-Biamila, J. granted the appellant's claim in part. 

The resume of the material facts of the case, which transformed into the appeal, are incompatible with complexity.
