Judgement

FREDERICK OZIAKPONO OHO, J.C.A. (Delivering the Leading Judgment): This is an Appeal against the Judgment of the Federal High Court, Awka in the Awka Judicial Division in Suit No. FHC/AWK/130/2012 delivered on the 25-2-2013 in which the Court below Coram: I. L. OJUKWU, J dismissed the Appellant's case holding that the cause of action of the Appellant as Plaintiff accrued in June, 2011 and not 10th February, 2012 when the report in Exhibit A was published and as such statute barred.

The Appellant brought a suit grounded basically on the provisions of Section 36 of the Constitution of the Federal Republic of Nigeria 1999, (as amended) by way of Originating Summons. In that suit, the complaint of the Appellant as Plaintiff centered on the fact that he was denied the right to fair hearing by the Visitation Panel Constituted in February 2011, by the 3rd Respondent pursuant to 15 (2) of Nnamdi Azikiwe University, Awka Act ACL. Cap N139 Laws of the Federation of Nigeria 2010.
