MOORE ASEIMO ABRAHAM ADUMEIN, J.C.A.(Delivering the Leading Judgment): The appellant was the 2nd accused person in Charge No. A/42C/2011 where together with the 1st accused one David Erutere, he was charged with the following offences:

STATEMENT OF OFFENCE: COUNT 1

Conspiracy to commit a felony to wit: Kidnapping punishable under Section 516(c) of the Criminal Code Cap. C21 Vol. 1, Laws of Delta State of Nigeria, 2006.

PARTICULARS OF OFFENCE:

David Erutere (m), Sunday Okailkwo (m) and others now at large on or about the 10th day of June, 2011 at Ekrata Community in Kokori Town within the Isiokolo Judicial Division conspired among yourselves to commit a felony to wit: kidnapping.

STATEMENT OF OFFENCE: COUNT II

Kidnapping punishable under Section 364(2) of the Criminal Code Cap C21 Vol. 1, Laws of Delta State of Nigeria, 2006.

PARTICULARS OF OFFENCE:
