ROWLAND JCA (Delivering the Lead Judgment): This is a case that came to this court by way of case stated by the High Court of the Federal Capital Territory, Abuja following an action by the plaintiff for recovery of contract debt owed him, by the defendant - Federal Capital Development Authority (FCDA).
The facts of the case as borne by the records run thus:
The plaintiff in May 2001, instituted this action against the defendant
“FCDA” at the High Court of the Federal Capital Territory, Abuja claiming the following reliefs -
(a) N750,802.50 (seven hundred and fifty thousand, eight hundred and two naira, fifty kobo). (b) N197,085.65 (one hundred and ninety-seven thousand , eighty-five naira, sixty-five kobo) being 21% interest per annum on the said sum from 15th February, 2000 up to 1st June, 2001; and 21% interest on the said sum of N750,802.50 from 2nd June, 2001 up to the date of judgment. 10% interest per annum from the day of judgment until the judgment debt is liquidated.” From…
