Judgement

MSHELIA JCA (Delivering the Lead Judgment): The 1st and 2nd respondents as claimants commenced suit No. ID/2394/92 at the Lagos State High Court, Ikeja Division and in the amended statement of claim dated 16 June 1998 claimed against the appellant (then defendant) the following reliefs:

i. A declaration that the plaintiffs are entitled to statutory right of occupancy in respect of the piece or parcel of land situate, lying and being at Oweh Street, Igbobi, and covered by a deed of conveyance dated 26 July 1966, registered as No. 32, at A page 32, in volume 1253 of the Register of Deeds, Lagos, between the late Emmanuel Adejunji Molajo and the Eyisha Family.

ii. A declaration that the 1st defendant is a licensee of the Late Emmanuel Adetunji Molajo in respect of the aforesaid land.

iii. An order forfeiting the aforesaid licence on the basis of the 1st defendant’s refusal to pay the annual fees and denying the title of the late Mr. E.A. Molajo.
