JOSEPH SEGUN OLABODE V. KANO ROAD & TRAFFIC AGENCY (KAROTA) & ATTORNEY GENERAL OF KANO STATE

MOHAMMED AMBI-USI DANJUMA, J.C.A. (Delivering the Lead Judgment): This appeal is challenging the decision of the High Court of Kano State in Suit No. K/21/2017 delivered on 27/05/2019. 

The Appellant (then Plaintiff) at the trial Court via originating summons prayed for the following reliefs: 

1. A Declaration that there is no criminal offence known as “Broken Glass” under the Kano Roads and Traffic Agency Law 2012 of Kano State and no penalty prescribed thereof. 

2. A Declaration that the arrest of the plaintiff and the impounding of the plaintiff’s car Registration Number AG 224 ABS on the 29th December, 2016 by the 1st defendant is illegal, unlawful, unconstitutional and abuse of power. 

3. An order directing the 1st defendant to refund the N4,000 (Four Thousand Naira) paid by the plaintiff as fine to the 1st defendant. 4. Special damages in the sum of N790,800 (Seven Hundred and Ninety Thousand Eight Hundred Naira only). 

5. General Damages in the sum of N13 million Naira.
