AHMAD OLAREWAJU BELGORE, J.C.A. (Delivering the Leading Judgment): By an Amended Charge Sheet filed on the 24th day of June, 2013, the Appellant herein was arraigned before the Federal High Court sitting at Ado-Ekiti, Ekiti State. This two-count charge, like the one filed on the 30th day of April, 2013, contained no Proof of Evidence. The charge sheet reads as follows:-

That you Muri Olore and others at large, sometimes between September, 2011 and March, 2012, in Ado Ekiti, within Ado Ekiti Judicial Division, did conspire to commit felony to wit fraud and thereby committed an offence contrary to Section 8(a) and punishable under Section 1 (3) of the Advance Free Fraud and Other Related Offences Act 2006.

COUNT 2: That you Muri Olore and others at large, on the same date, place and within the same Judicial Division, under false pretence and with intent to defraud, claimed that you can solve the matrimonial problem of one Tosin Olofinkuade through the use of juju and subsequently introduc…
