MUSDAPHER, JCA (Delivering the Lead Judgment): In the High Court of Justice of the Federal Capital Territory Abuja in Suit No. FCT/HC/119/ 95, the plaintiff, Dr. James Olukayode Omole, claimed against Mallam Ibrahim W. Abubakar and the New Nigerian Newspapers Ltd., the sum of 10 million naira jointly and severally being damages for defamation. In that on the 5th day of December, 1994, the defendants falsely and maliciouslypublished on page 4 of the New Nigerian Newspapers dated that day of and concerning the plaintiff the words following:-
