ABUBAKAR JCA (Delivering the Lead Judgment): This appeal is against the judgment of the High Court of Lagos State, delivered by Akande

J, (later CJ, Lagos State) on 11 November 2008. The respondents as plaintiffs at the court below initiated an action against the defendant, now appellant by a writ of summons, claiming the following reliefs against the defendant: The sum of N640,000.00 (six hundred and forty thousand A naira) only, being the amount of commission payable to the plaintiffs for their services as agents under an agreement made on 31 December 1992, between the plaintiffs and the 1st defendant and about the sale of authority. The 2nd defendant acted as the guarantor to the agreement. Alternatively, the sum of N900,000.00 (nine hundred thousand naira only) as damages for breach of contract. The plaintiffs also doing interest at the rate of 26% from 13 September 1993 until judgment is delivered thereafter and 6% until the final liquidation of the said debt.
