Judgement

IBIYEYE, JCA (Delivering the Lead Judgment): This appeal is from the decision of Uwerhiavwe, J. of Ughelli Division of Delta State High Court in Suit No. UHC/24/90 delivered on the 12th day of October, 1994. The appellant, as plaintiff, instituted this action against the two respondents, as defendants jointly, seeking the following reliefs in paragraph 18 of his amended statement of claim.

“18. Whereas the plaintiff claims as follows:

(a) A declaration that the plaintiff in still in the employment of the 2nd defendant as Security Supervisor I in the Western Operation Department Ughelli branch of the 2nd defendant company, a subsidiary of the 1st defendant corporation, wholly owned and controlled by the 1st defendant corporation.

(b) The purported termination of the appointment of the plaintiff with immediate effect by letter reference AD/PER/C.1861 dated the 30th day of November, 1989 and signed by C.O. Uduahi for Managing Director of the 2nd defendant company, is null and void and of …
