AMAIZU JCA (Delivering the Lead Judgment): This is an appeal A against the ruling of Apkeri J., of the Warri Judicial Division, of the Delta State High Court. The ruling was delivered on Wednesday, the 1st day of August, 2001. Briefly, the facts of the case that led to this appeal are as follows - The plaintiff claims that the defendant promised to marry her. The defendant allegedly breached his promise. Because of the alleged breach, the plaintiff filed an action in the court claiming: “1) The sum of N20,000,000 (twenty million naira) being damages suffered by the plaintiff for breach of promise to marry her made to her by the defendant in December, 1986, (and renewed every year up to June 1999, and April 2000) at various placesin Warri. 2) An order compelling the defendant to perfect/complete all the marriage arrangements concerning the plaintiff which the defendant earlier commenced with plaintiff ’s parents/ relations.” Pleadings were filed and exchanged.
