Judgement

MONICA BOLNAAN DONGBAN-MENSEM, J.C.A. (Delivering the Leading Judgment): This is an appeal against the decision of the High Court of Ogun State holden at Ilaro Coram Hon. Justice O. A. M. Onafowokan delivered on the 3rd day of June, 2011 pg. 118-137 of the record transmitted on 26/10/11 and deemed on 6/06/16. The Appellants, also referred to as the Plaintiffs while the Respondents were the Defendants and shall respectively be referred to as Appellant and Respondent as applicable.

FACT OF THE CASE

The facts as averred in the Plaintiffs amended statement of claim is that they are the owners of the land in dispute. That they became seised of the land in dispute through their ancestors Adelu who migrated from Ile Ife to first settle at a place in Otta which later became known as Ikowogbe Compound, that Adelu hunted far and wide and during his hunting expedition, founded and settled on the land in dispute. Adelu hunted and farmed on the land in dispute with his wife and son Olukori.
