UCHECHUKWU ONYEMENAM, J.C.A. (Delivering The Leading Judgment): This appeal is against the judgment of the High Court of the Federal Capital Territory, sitting at APO, delivered on 8th July, 2020 by Olukayode Adeniyi, J., in CHARGE NO: FCT/HC/CR/321/17 wherein the learned trial Judge convicted the Appellant on counts 3 and 5 of the 5 counts charge filed by the Respondent.

The facts of the case at the trial Court is that the Appellant and a Co-Defendant (Mohammed Musa Abimiku) were tried in a five count charge on allegations of making false returns, conferment of corrupt advantage upon themselves, making false statement and criminal breach of trust contrary to Sections 16, 19 and 25 of the Corrupt Practices and other Related Offences Act, 2000 and Section 311 of the Penal Code. At the trial, the Respondent herein called 6 witnesses and tendered 16 exhibits and closed her case. The Appellant and his Co-Defendant on the other hand entered a no case submission.
