RULING

I. INTRODUCTION

[1] Before the Court is the Applicant’s Notice of Motion application dated 20th April 2017 and filed on 26th April 2017. The application is brought under Sections 21(2) and 24(2) of the Supreme Court Act, 2011, Rule 4(4) of the Supreme Court Rules, 2012 and all other applicable provisions of the law.

[2] The application seeks to review a Two Judge Bench decision of this Court delivered on 24th March, 2017 in Application No. 10 of 2016, Parliamentary Service Commission v. Martin Nyaga Wambora and Others, which dismissed the Applicant’s plea for extension of time to file an appeal out of time.

II. BACKGROUND

[3] The Applicant first moved this Court via Application No. 10 of 2016, Parliamentary Service Commission v. Martin Nyaga Wambora and Others filed on 25th May, 2016 seeking for extension of time to file a petition of appeal.
