RITA NOSAKHARE PEMU, J.C.A. (Delivering the Lead Ruling): On the 1st of June 2011, the Applicant argued his motion filed on the 8th of February 2016, having obtained an order extending time to file their written address in support of the Notice of Motion to adduce fresh evidence filed on the 8th of February 2016, on the 1st of June 2016. The Written address filed on 31/5/2016 was deemed filed on the 1st of June 2016.

On the same 1st of June 2016 the 1st Respondents' Written address filed on the 19th of May 2016 was deemed filed on that day.

The 2nd Respondent filed no Written Address.

Parties thereafter i.e. the Appellants/Applicants and the 1st Respondent adopted their respective written addresses.

The motion proper filed on the 8th of February 2016 was then moved by the applicants. It is for AN ORDER, granting leave to the Appellants/Applicants, at the hearing of this Appeal, to adduce further and or additional evidence to wit:
