AMAIZU, JCA (Delivering the Lead Judgment): This is an appeal against the ruling of Orilonise, J. of Kwara State High Court sitting at the Ilorin Division. The ruling was delivered on the 22nd day of February, 2000. Briefly, the facts that led to this appeal are as follows - By a writ of summons dated 17th November, 1991, the plaintiffs, now the respondents, brought an action against the defendants, now the appellants, claiming - “1. Declaration that the purported selection and or election of the 6th November, 1991 is null and void being that a valid election had been held on the 16th of October, 1991 and concluded.

A declaration that the election that was held on the 16th of October, 1999 was conducted according to the wishes and aspiration of the people and due regard the party constitution and guidelines (sic).
