Judgement

TUNDE O. AWOTOYE, J.C.A.(Delivering the Leading Judgment): This is the Judgment in respect of the appeal of the defendants in suit No. SS/80/2012 Attorney General of Sokoto State and 1 other V. Power Holding Company of Nigeria Plc and 1 other, against the ruling of Sokoto High Court delivered on 16/5/2013.

The plaintiff's claims against the defendants are as contained in paragraph 30 of their statement of claim which reads as follows;

"a. The sum of N1,698,880.00 (One Million, Six Hundred and Ninety Eight Thousand, Eight Hundred and Eighty Naira Only) being the amount spent on diesel for the generator (alternative power source) from the 23rd October, 2012 to 26th October, 2012.

b. The sum of N2,250,000.00 (Two Million, Two Hundred and Fifty Thousand Only) being the amount for changing the 2nd Plaintiff's 150mm XPLE HT (3 core) armored cable.
