Judgement

STANLEY SHENKO ALAGOA, J.C.A. (Delivering the Leading Judgment): In the High Court of Justice Ota, Ogun State of Nigeria, the present Respondent as Plaintiff took out a writ of summons against the present Appellant as Defendant claiming as follows:

1. A DECLARATION that the dismissal or purported dismissal of the plaintiff by the defendant as contained in a letter Reference No.251/C.45/3/3668/87 dated the 14th day of October, 1987 from the services of the National Electric Power Authority with effect from the 14th October, 1987 is unlawful in that it is against the principles of natural justice, ultra vires, null and void and of no effect.

2. A DECLARATION that the plaintiff is still in the service of the National Electric Power Authority and is entitled to his full remuneration and leave bonus from the date of Purported dismissal.

3. A DECLARATION that the plaintiff is also entitled to all his entitlements as an employee of the defendant.
