UWANI MUSA ABBA AJI, JCA (delivering the Leading Judgment): This is an appeal by the Appellants, who were the petitioners at the National Assembly Election Petition Tribunal sitting in the Federal Capital Territory Abuja against the decision of the National Assembly Election Tribunal as contained in the judgment delivered on Wednesday, 2nd day of July, 2008 in Petition No EPT/FCT/ABJ/S/02/08, Progressive Peoples Alliance (PPA) and Anor V. Independent National Electoral Commission (INEC) and 3 ORS. The Tribunal dismissed the petition filed by the Appellants upon objection raised by the respective Respondents.

The 1st Respondent conducted a general election to the office of Senate representing the Federal Capital Territory on the 21st day of April, 2007. The election was nullified by the Tribunal following a petition to it. The 4th Respondent was a candidate of the 3rd Respondent at the said election.
