UWANI MUSA ABBA AJI, J.C.A. (Delivering the Leading Judgment): By a motion on notice filed on the 22nd July, 2008, brought pursuant to Order 7 Rules 1, 7, 9, 10(2) of the Court of Appeal Rules 2007, the Applicant prayed the court for the following orders;

a) An extension of time within which to seek leave to appeal against the judgment of Hon. Justice Husseini Baba Yusuf sitting in High Court 9 of the High Court of the Federal Capital Territory, Abuja given on 25th January, 2007 in Suit No: FCT/HC/CR/009/05.

b) Leave to appeal against the judgment of Hon. Justice Husseini Saba Yusuf sitting in High Court 9 of the High Court of the Federal Capital Territory, Abuja given on 25th January, 2007 in Suit No: FCT/HC/CR/009/05.

c) Extension of time to file Notice and Grounds of Appeal.

d) An order of court deeming the Notice and Grounds of Appeal already filed as properly filed and served, the necessary fees having been paid.
