ESSIEN J (DELIVERING THE JUDGMENT): By an originating summons dated and filed on the 20/5/2019, the claimant in this action sought the determination of the following question:

1)    Whether going by the provisions of Section 40 of the 1999 Constitution of the Federal Republic of Nigeria, Trade Unions Act and the Constitution of the plaintiff as approved by the Registrar of Trade Unions, the Plaintiff have rights to unionise its members from supervisory or equivalent level upward or otherwise known as senior staff in every pulp paper and paper products, printing, and publishing companies, industries or co-operations wherever it exist in Nigeria.

2)    Whether By virtue of the provisions of the Trade Unions Act, the jurisdictional scope of the defendant should not be limited to junior staff while that of the Plaintiff to senior staff within the pulp paper and paper products, printing, and publishing companies and industries in Nigeria as approved and registered by the Registrar of Trade …
