JAMILU YAMMAMA TUKUR, JSC (Delivering the Leading Judgment): This is an appeal against the judgment of the Court of Appeal sitting at the Kaduna Division (hereinafter referred to as the "Lower Court"), delivered on 16th day of December, 2019 with Appeal No. CA/K/438/2019 wherein the Court dismissed the appeal of the Appellant and affirmed the judgment of the trial High Court of Kano State.

The facts of the case are that the Appellant, a 35-year-old man, was arraigned on 16th May 2012 on a charge of rape involving one Hajara Tukur, a 12-year-old girl, alleged to have occurred on the 4th October 2011 at approximately 07:30 hours at Filing Kwallo Quarters Darnbatta, Kano State, in Charge No: K/290c/2011. The incident was reported to the Divisional Police Station, Dambatta, by PW4, the victim's elder brother.
