OMAGE JCA (Delivering the Lead Judgment): In this appeal, the appellant was the 1st plaintiff in the court below. It consists of officers and members of the Incorporated Trustees of Conference of Secondary School Tutors, Nigeria otherwise known as COSST, the 1st - 4th respondents in their brief filed on 17/5/05 described it as a registered corporate body. In suit No. KGS/OK/1/2003, the appellant commenced proceedings by originating summons against (1) Hon. Commissioner of Education, Kogi State (2) Teaching Service Commission, Kogi State (3) Science, Technology and Technical Education, Kogi State (4) Attorney-General, Kogi State (5) Nigerian Union of Teachers, Kogi State. In the suit the plaintiff sought the following reliefs: A declaratory order that the 1st plaintiff has a civil right to exist, and does exist from 9th March, 2001 for the purposes of its objectives as incorporated under the Companies and Allied Matters Act, 1990. 2.
