REGISTERED TRUSTEES OF FRUITS AND VEGETABLE SELLERS ASSOCIATION MARARABA-GURKU & ANOR V. MANU KUSADA

(Delivering the Leading Judgment): This appeal is against the judgment of the High Court of Nasarawa State, holden at Mararaba Gurku (the trial Court) delivered on 1/8/2012 in Suit No. NSD/MG.104/2008 in which the trial Court dismissed the claims of the appellants (as plaintiffs) against the respondent (as defendant). The trial Court went ahead to grant the counter-claim of the respondent against the appellants.

The respondent was the chairman of the 1st appellant, elected in 2007 for a term that was to last until 2011. Sometime in 2008, he was accused of misappropriating various sums of money belonging to the 1st appellant. A committee was set up to look into the allegations against him. On 28/11/2008 members of the 1st appellant considered the report of the committee and voted to impeach him from his office as chairman of the 1st appellant.
