JUDGEMENT 

i. Introduction 

[1] On September 16, 2011 the 1st Defendant Ghana Private Road Transport Union (GPRTU)  hereafter called the “Union” of Trades Union Congress (TUC) suspended the 2nd Defendant for a  period of three months on grounds of insubordination and misconduct. At the time, according to  the 2nd Defendant, he had worked with the Union for a period of 30 years. The 2nd Defendant being aggrieved and dissatisfied with the decision of the Union, contested his suspension at the  National Labour Commission (NLC), which by its decision overturned the suspension. The 2nd  Defendant thereafter put himself up as a candidate for elections as General Secretary of the Union  in September 2015 and won overwhelmingly. It is the case of the Plaintiffs that the 2nd Defendant  was not eligible for elections in September 2015 because he had been dismissed as a member of  the Union and also did not meet the eligibility criteria.
