MOHAMMED LAWAL GARBA, J.C.A. (Delivering the Leading Judgment): By a writ of summons and statement of claim dated the 29th April, 2009, the Appellant had sued the Respondent before the High Court of Lagos State for the following claims: -
"The Claimant claims are here below particularized:-
(a) Two years rent from 1st February 2007-31st January, 2009 as per Sublease Agreement is N9, 581,760 less N1, 249,920 credit to the 31st January 2007 is - N8, 331,840
(b) 21% interest per annum thereon from 1st February 2007 to - N3, 499,372.80
(c) Rent payable for 1st February, 2009 to 31st January, 2011 as per agreement is N9,581,760 plus 15% increase = N11, 019,024
(d) Rent for 40 days based on the (c) above is N11, 019,024/365 = N30, 189.2 per day x 40 days period of holding over = N207, 564:20
Grand Total = N13, 038,77;00."
