OGBUAGU JCA (Delivering the Lead Judgment): This is an appeal against the decisions of the Plateau State High Court, Jos by Oyetunde J. delivered on 1st December, 1999 in favour of the plaintiff/respondent for the sum of $3,760.00, 10% interest and N100,000.00 as general damages after dismissing the claim for general damages. He also awarded N10,500.00 costs in favour of the respondent. The learned trial Judge also dismissed the counter-claim of the defendants/appellants. Dissatisfied with the said decision/decisions/judgment, the appellants, have appealed to this court.

By a writ of summons in Suit No. PLD/J335/95 and in paragraph 17 of the amended statement of claim, the plaintiff/respondent, claimed from the defendants/appellants jointly and severally, as follows:
